Transfer pricing documentation requirements in Belgium: delay until 31 March 2018 granted by tax authorities

The Program law of 1 July 2016 adopted specific transfer pricing documentation requirements. The reporting requirements took effect from assessment year 2017.
In application hereof, certain enterprises needed to file transfer pricing documentation forms 275CBC, 275MF and 275 CBCNOT before end of December 2017.
To comply with these transfer pricing documentation requirements, the aforementioned forms need to be filed electronically in a valid XML format via MyMinfinPro.
For the first year, the Belgian tax administration provided a 3 month delay until 31 March 2018 for the filing of:
- Form 275 CBC (Country by Country reporting) for assessment year 2017
- Form 275 MF (Master File) for assessment year 2017
- Form 275 CBC NOT (notification CBC) for assessment year 2018.
However, as the filing of forms 275 CBC and 275MF requires quite a lot of work, we would recommend to prepare the forms as soon as possible.
To comply with the required documentation requirements an IT tool that generates XML files is highly recommended. BDO has developed such a tool and can assist you with the filing of the transfer pricing documentation forms.
