2020 Social elections procedure resumed

The Royal Decree on the resumption of the social elections procedure has been published. The social elections 2020 will effectively take place in the period between 16 and 29 November 2020 instead of between 11 and 24 May.
New election date automatically fixed
The new actual election date within each company will in the first place follow automatically from a logical integration of the original election day in the newly determined election period.
For example: if the initial election date in your company was 19/05/2020 (the Tuesday of the second week of the election period), this means that the new election day will also fall on the Tuesday of the second week of the new election period, i.e. on Tuesday 24 November 2020.
Existing consultative bodies may, however, deviate from this principle of automatism and choose a new, more appropriate date, according to the rules set out in their internal regulations. If there are no consultative bodies, the employer can take this decision himself, if necessary.
The RD also regulates the adoption of a possible new voting time schedule, as well as the obligation to communicate and post the new electoral calendar.
