What are the next steps I have to take in the social elections?

Organising social elections is a complex and formal task. This year too, we are guiding numerous clients through the entire social election process. What are the next steps?

1.    Day X-60: first announcements

Sixty days before posting the notice announcing the date of the election (day X), the employer is required to communicate some information about the company. In particular:

  • The number of technical business units;
  • The number of staff by category;
  • The positions of managers and executives;
  • The indicative list of managers and executives;
  • The day on which the elections will be announced.

2.    Day X-60 > X-35

During this period, the employer organises consultations regarding the information communicated on day X-60. On day X-35, decisions relating to that information will be communicated. 

3.    Day X-30 > X+35: occult period

The occult period is the period during which employees can submit their candidacy for the social elections and, subsequently, enjoy dismissal protection. Starting from 30 days before day X, each employee who is a candidate is protected against dismissal. On the 35th day after day X, the candidates are announced. So, dismissals during this period are inadvisable because, as an employer, you don't know who the candidates are and dismissal protection applies.
